These Terms of Service (“Terms”) govern your use of AlpHexa and all related services provided through https://alphexa.ch. By creating an account or using our services, you agree to these Terms in full. If you do not agree, do not use our services.

2. Services

AlpHexa provides web application development, website creation, and privacy-friendly website analytics. We may modify, suspend, or discontinue any part of our services at any time with reasonable notice.

3. Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must not share your account or allow others to access it on your behalf.
  • You must notify us immediately if you suspect unauthorized access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable use

You agree not to use AlpHexa to:

  • Violate any applicable law or regulation.
  • Infringe on the intellectual property rights of others.

5. Analytics service

Our analytics service collects anonymized, non-personal data as described in our Privacy Policy. By using our analytics tracking script on your website, you agree that:

  • You have the authority to embed tracking on the website in question.
  • You will link to our Privacy Policy or include equivalent disclosures on your website.
  • You will not attempt to reverse-engineer anonymized data to identify individual visitors.

6. Intellectual property

All content, code, designs, and branding on AlpHexa are owned by us or our licensors. You may not copy, modify, or distribute any part of our platform without written permission. For websites and applications we build for you, ownership and licensing terms are defined in your individual project agreement.

7. Limitation of liability

To the maximum extent permitted by Swiss law, AlpHexa and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services. Our total liability for any claim related to our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Disclaimer of warranties

Our services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that our services will be uninterrupted, error-free, or secure.

9. Termination

We may suspend or terminate your access to our services at any time for violation of these Terms, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination (including liability limitations and governing law) will remain in effect.

We may update these Terms from time to time. Material changes will be communicated through the platform or via email. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.

11. Governing law & jurisdiction

These Terms are governed by the laws of Switzerland. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of the Canton of Vaud, Switzerland.
